Meet "Olaf" - Electric Golf Cart

This Liability Waiver and Agreement (the “Agreement”) is entered into between Beaches and Dreams Property Management (the “Property Owner”) and the undersigned guest (the “Guest”) in consideration of the use of a 6-seater Low-Speed Vehicle (LSV) located at the Beaches and Dreams property.

1. Valid Driver’s License and Insurance

The Guest acknowledges that only individuals who are 25 years of age or older and have supplied the Property Owner with a valid driver’s license and proof of personal vehicle insurance are permitted to operate the LSV. These documents must be provided prior to the use of the LSV.

2. Eligibility to Operate

Only guests who have supplied the required documents (valid driver’s license and proof of insurance) are allowed to operate the LSV. No other individual is permitted to operate the LSV without first providing the necessary documentation.

3. Compliance with Local Laws

The Guest agrees to comply with all local laws and regulations pertaining to the operation of low-speed vehicles (LSVs). It is the Guest’s responsibility to understand and follow the applicable rules, including but not limited to speed limits, seatbelt use, and driving restrictions within designated areas.

4. Required Safety Video

The Guest is required to watch the LSV safety video prior to operating the vehicle. A link to the safety video will be provided by the Property Owner. The Guest agrees that operation of the LSV is prohibited until the safety video has been watched in full.

5. Liability Waiver

The Guest agrees to operate the LSV at their own risk. The Property Owner assumes no responsibility or liability for any injuries, accidents, damage, or losses incurred during the use of the LSV. The Guest acknowledges that they have full responsibility for the safe operation of the LSV and any damages caused during its use. The Guest agrees to release, indemnify, and hold harmless the Property Owner, its employees, and agents from any and all claims, liabilities, or costs arising from the use or operation of the LSV.

6. Damage Responsibility

The Guest agrees to assume full financial responsibility for any damage caused to the LSV during their period of use. In the event of damage, the Guest agrees to cover all repair or replacement costs, as determined by the Property Owner.

7. Acknowledgment of Risks

The Guest acknowledges that operating an LSV carries inherent risks, including the potential for accidents, injury, or death. The Guest certifies that they have reviewed and understood these risks and agree to assume full responsibility for their safety and the safety of any passengers while operating the LSV.

8. Signature and Agreement

By signing this Agreement, the Guest agrees to all terms and conditions outlined above, confirms that they are 25 years of age or older, have provided a valid driver’s license and proof of insurance, will operate the LSV in compliance with all local laws, and have watched the provided safety video.
